Should it or should it not exist?
Is it wrong to use the characters and setting of an author as a stepping stone for one's own work? Or is it justifiable as a form of practice in literature? Perhaps somewhere in between.

I think, to an extent, it’s okay. Fanfictions authors (for the most part) put at the top (or bottom) that they don’t own it; they admit that they are not their characters, and they own only the account they posted it on. Now, I don’t agree with the ones that publish it for money.
Again, to an extent. Mostly because of what kind of fanfiction. If it’s a television show, there are a lot of writers. Same with a movie. Plays, there’s one. Same with books. So with so many writers for shows I could see people writing another episode. No one really owns writing it. they just own the money rights to it.
Books, though, depend on the owner. There are authors that won’t let fanfiction be published on websites like FF.N.
Personally, I think that so long as you don’t make money, and put a disclaimer saying that you know you don’t own it and are not making money off of it, it should be fine.

I don't think it's wrong because all a fanfic is, is a book online. It would be different if the author tried to publish it or something. But let's say for the Anita Blake Series by Hamilton, she doesn't own the world of vampires and other types of were's so I believe someone could publish their own book like that involving were animals and vampires.
I wonder what ever happened in the case of lawsuit against Rowling and HP Lexicon?

That was blown out of proportion. Lexicon wasn’t making money, they had nothing that the books didn’t already provide. All they did was make lists and easily accesable information for people on the internet. You can read the books and not know where half the classes are unless you dissect the thing with a toothpick. They did that for you.
Nothing really happened, Lex just had to take it down, or pay her. I think they did a bit of both. What a pain though. Really, if people are writing about the book for college or something, it was really handy. I know I used it and mugglenet all the time for my role plays. Not having it there makes things hard.
They weren’t making money, they asked for donations now and then to keep their name. That’s it basically. They weren’t claiming their information to be theirs; they gave her plenty of credit. Rowling just let her fame get to her head. “I’m important, so anything that has anything to do with Harry, that I didn’t put my name on myself, I’m going to sue.”
Sorry, but I think she’s a royal bitch for doing that. Lost a lot of fans for doing something like that. We liked it because it helped us get more into her world, made it more real. She shot herself in the foot

I agree. Rowling admitted that she used the website to write the books, I found a news article ages ago when I first read about the cast case. Then she made a big deal of claiming how she was going to donate the money from her sales to charity, totally off the topic there for her like a cheap shot a kid would take to get their side chosen. I read on wiki that muggle something made six figures from adverts. I think Lexicon should have won for the sole purpose that Rowling admitted to using his website to write the books, she should have kept her own notes.

I honestley must admit I approve fanfiction to an extent, and I'm not being bias as a fellow Fanficition writter myself. I have written many of fanfic of simple video games and such. Now I do not agree with writting a fanfic to add on to a great book, The author placed their time and effort into creating it. And much like Colin said, a simple tv show or movie, or heck in my case a video game series is just seen as an add on.
I have written about 27 fanfictions myself. (I think they suck personally) 21 of them are based on a video game known as Resident Evil. Now I try and stray away from the typical thing of Resident evil, I make my own setting, I Do not use S.T.A.R.S, nor do I use Umbrella corperation however I do use the tyrants and bio-weapons as well as some viruses and cannon characters.
I will say this in defence of fanfic writters, when we write a fan fic we do it out of love for what we write about and sometimes we write out of our wish for a countinuation of that thing we love. So, My vote is yes. Fan Fiction should be supported.

I don't see anything wrong with fan fiction really. But, in my mind? It's a waste of time. Why bother writing about something you wish could have happened when you can write your own stuff? It's just a waste of time >>;
